Terms of Service

Last updated: October 11, 2026

01Acceptance

These Terms of Service govern your use of the website rafaboni.uk, the applications we publish, and the services provided by Rafaboni (“Rafaboni,” “we,” or “us”), collectively the “Services.” By using the Services, you agree to these terms. If you do not agree, do not use the Services.

02The Services

We offer web development, advertising campaign management, AI-powered virtual assistants (including A.R.I.A.), AI virtual receptionists, process automation, and AI brand characters for campaigns. The scope, price, and timeline of each project are defined in a written proposal or quote. Prices published on the website are for reference only and do not constitute a binding offer.

03Acceptable use

When using the Services, you agree not to:

  • Use them for any unlawful, fraudulent, or deceptive purpose, or in a way that infringes third-party rights.
  • Send spam or place calls or send messages without the consent required by law.
  • Attempt to gain unauthorized access, interfere with their operation, or reverse engineer them.
  • Use the AI assistants to generate content that is unlawful, abusive, or impersonates others.

04Third-party accounts and integrations

Some Services connect to third-party platforms (for example, Google, Meta, WhatsApp, Twilio, or Cloudflare). You are responsible for your credentials and for complying with those platforms’ terms. We are not responsible for changes, failures, or decisions made by third parties, such as the suspension of an advertising account.

05Payments and third-party costs

Payments are made as agreed in each proposal. Unless otherwise stated, third-party costs (advertising spend, Meta messaging fees, telephony minutes, licenses, or API usage) are the client’s responsibility. Monthly services renew each month until either party cancels them with the agreed notice.

06Client obligations

  • Provide the information, access, and content needed for the project in a timely manner.
  • Ensure that it holds the rights to the text, images, trademarks, and data it provides to us.
  • Comply with the privacy, advertising, and telecommunications laws applicable to its business, including obtaining its customers’ consent for calls, messages, and recordings.

07Intellectual property

Upon payment in full, the client owns the deliverables created specifically for it (for example, the design and code of its website). Rafaboni retains ownership of its tools, templates, methods, and pre-existing know-how, and may showcase the work performed in its portfolio unless a confidentiality agreement provides otherwise. The content of the rafaboni.uk website and the Rafaboni brand belong to Rafaboni.

08Artificial intelligence

AI assistants and automations may make mistakes or provide inaccurate responses. The client is responsible for reviewing the configuration and any critical responses. The Services are not a substitute for legal, medical, financial, or any other professional advice.

09No guarantee of results

We work with professional diligence, but we do not guarantee specific results, such as a number of sales or customers, search engine rankings, or campaign performance, because these depend on factors beyond our control. The Services are provided “as is” and “as available.”

10Limitation of liability

To the fullest extent permitted by law, Rafaboni will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or loss of data. Rafaboni’s total liability for any claim related to the Services is limited to the amount paid by the client in the 12 months preceding the event giving rise to the claim.

11Indemnification

You agree to indemnify and hold Rafaboni harmless from any third-party claims arising from your breach of these terms, the content you provide, or your use of the Services.

12Confidentiality

Each party will keep confidential any non-public information it receives from the other and will use it only to carry out the project.

13Suspension and termination

We may suspend or terminate access to the Services if these terms are breached or for non-payment. The client may terminate monthly services with the agreed notice; work performed up to the termination date will be invoiced.

14Privacy

The processing of personal data is governed by our Privacy Policy.

15Governing law

These terms are governed by the law applicable where Rafaboni is established, without prejudice to any rights you may have as a consumer under the laws of your country. The parties will attempt to resolve any dispute directly and amicably before pursuing other remedies.

16Changes

We may update these terms. The current version will always be posted on this page with its last-updated date.
